Terms & Conditions Of Hire & Sale

  1. Express Instrument Hire Limited (hereinafter known as “The Company” will hire the items described for the rental and period shown. If no specific period of time has been agreed, either party may, by giving seven days notice, terminate the hiring.
  2. Charges for hire will be as specified in our price list, or as agreed, subject to a minimum period of time, of one week or as agreed. Delivery and collection of equipment is charged at cost.
  3. The period of hire commences on the day the equipment is delivered to the hirer and continues until the equipment is returned to our depot.
  4. The hire period is one week of seven consecutive days inclusive. The hirer may retain the equipment for longer than seven days without notice to the Company. The extended hire will be for complete weeks, with any period less than a week being treated as a full week for invoicing.
  5. The manufacturer’s instructions and other regulations of the hired equipment will be observed at all times by the hirer. The hirer shall be entirely responsible for the proper use of the said equipment and also shall be responsible for any damage caused to the said equipment through failure to observe such instructions or regulations.
  6. It will be the hirer’s responsibility;
    1. a) Not to subject the said equipment to any unfair wear and tear or misuse and to use the said equipment in a proper manner.
    2. b) To preserve Express Instrument Hire Limited’s or the manufacturer’s identification number or mark on any nameplate that may be on the said equipment.
    3. c) To keep the said equipment safe from damage and in good condition whilst it is in the hirer’s use and possession.
    4. d) To indemnify Express Instrument Hire Limited in respect of loss or damage to the said equipment howsoever caused, except for the fair wear and tear and normal use. In the event of damage, theft or loss, the hirer shall notify Express Instrument Hire Limited immediately. Express Instrument Hire Limited will quote a reasonable sum covering the cost of repair or replacement plus any loss on income as applicable to be paid by the hirer. The normal hire rate shall continue until the full amount of the said sum is paid to Express Instrument Hire Limited. It is the responsibility of the hirer to ensure that full insurance is in place whilst the equipment is in the hirers possession to cover such losses.
    5. e) In the event of the equipment being found defective on receipt or during use. Express Instrument Hire Limited must be notified immediately. Replacement or repair will be effected with minimum possible delay.
  7. The hirer will not hold Express Instrument Hire Limited responsible for any loss, damage or injury (including death) to persons or property with regards to use of any equipment hired.
  8. In cases of default of payment, Express Instrument Hire Limited are entitled to recover the said equipment without notice.
  9. In the event of equipment being hired for use outside the UK or in a hazardous environment, responsibility of arranging the appropriate insurance cover to the full replacement value of the said equipment lies with the hirer. A copy of the Certificate of Insurance must be provided to Express Instrument Hire Limited.
  10. Payment of invoices: terms are strictly nett within 30 days of the date of invoice. Express Instrument Hire Limited reserves the right to charge interest/debt collection fee on all overdue accounts.
  11. Any equipment purchased from Express Instrument Hire Limited will remain the property of the company until full payment has been made for the said equipment.
